Booking Terms & Conditions.

This document is a draft. It sets out how the service actually works today and is provided so you can read and keep it, but it is not yet issued as the final production terms: release depends on completing the operator's registered identity and confirming its legal commercial role. Where this draft is silent or incomplete, your rights under applicable law are unaffected.

These Booking Terms apply to accommodation booking services offered under BookCuraçao.com and Latitude12, subject to the final legal-entity and contract-role sign-off. They cover accommodation booked through this website or through Latitude12 services, and the enquiry and quote steps that lead to it.

The primary display brand on this Curaçao storefront is BookCuraçao.com. BookCuraçao.com and Latitude12 are trade names registered with the Chamber of Commerce Curaçao under number 163245. Both names are protected brand names. Enquiries, including legal and complaint correspondence, reach us at hello@bookcuracao.com. The registered legal name and address of the operator will be published here before these terms are final.

BookCuraçao.com is the Curaçao-focused storefront. Latitude12 also offers booking services under its own trade name. Both use shared Latitude12 booking and payment infrastructure, and guests are not sent to the property, an owner or a supplier to complete booking or payment. How the contractual and commercial roles of the parties involved are legally characterised is being confirmed, and this document does not state it.

Your stay is delivered at the property you select, by that property. The supply and fulfilment steps that create and confirm your reservation happen behind the platform, and you do not have to deal with them. Which party is the accommodation contracting party in the legal sense is part of the role confirmation described above and is not defined here.

• Searching, browsing and requesting a price are not a reservation and do not hold anything.
• Checkout is offered only for a live quote that is eligible to be booked.
• A booking is not confirmed simply because you reached the end of checkout. It is confirmed when the booking status shown for your reference says so.
• Before you continue to checkout you can review and correct your dates, traveller numbers, ages and contact details on the page. If you notice a mistake afterwards, contact us and we will help put it right where the applicable rate terms allow.

The live quote for your selection controls the price. It shows the currency, the number of nights, the total and the breakdown that was returned for it, and we add no charges that are not shown there. A quote can expire or be repriced by the supply side before you complete checkout; if that happens you will be asked for a fresh quote rather than charged an unshown amount.

Payment is taken on Stripe's hosted checkout page. For the current hotel flow, the payment may be authorised first and captured after the supply side accepts the reservation. Other accommodation flows can charge differently, as shown before checkout, so we do not state one universal timing rule for every booking. What is shown to you as your booking status is authoritative for whether you have a booking.

Every booking receives a booking reference and a status. A completed payment step is not by itself confirmation that the accommodation is reserved; the status shown for your reference is what tells you that.

Cancellation and change terms are specific to the rate you book. Where those terms are supplied with your quote we display them, and they govern your booking. We do not invent a general refund right that the booked rate does not carry. If a rate's terms are not supplied to us, we will tell you rather than guess.

Accommodation reserved for a specific date or period generally falls outside the ordinary cooling-off rules for distance services under Curaçao law, as reflected in article 7:46i(3) of the Curaçao Civil Code. Where EU consumer rules apply to you, accommodation provided on a specific date or for a specific period is likewise excluded from the ordinary fourteen-day right of withdrawal under article 16(l) of Directive 2011/83/EU.

Nothing in this section limits any mandatory consumer right you have under the law that applies to you. Where such a right conflicts with these terms, that right prevails.

• Give accurate traveller information, including exact ages and country of residence where they are required to price and book the stay.
• Use a valid payment method that you are entitled to use.
• Observe the property rules that are lawfully disclosed to you.
• Do not use the service for unlawful activity, and do not cause damage at the property.

Descriptions and photography are there to help you choose. For the booking you actually make, the live commercial data returned for your quote — dates, occupancy, room or rate, price and terms — is what controls. If something material about your confirmed booking changes on the supply side, we will tell you and handle it under the applicable law and the terms of your booking. We do not reserve a general right to substitute a different property or stay for the one you booked.

Where performance is prevented or delayed by an event genuinely beyond our reasonable control, we will inform you promptly and work with you on the options available for your booking. This does not reduce any mandatory right you have under applicable law, including any right to a refund that such law or your booked rate terms give you.

We take care in operating this service and in the information we present. Nothing in these terms excludes or restricts liability where the applicable law does not permit it — including for death or personal injury caused by negligence, for fraud, and for any other liability that cannot lawfully be limited.

Beyond that, how responsibility is allocated depends on the applicable law and on the operator's confirmed legal commercial role, which is still being established. This draft therefore does not attempt a general allocation, and it contains no blanket exclusion of liability.

These terms are intended to be governed by the law of Curaçao. That choice does not deprive you, as a consumer, of the protection of any mandatory provisions of the law of your country of habitual residence where such protection applies to you. Disputes may be brought before the courts or authorities that have jurisdiction under the applicable law; these terms do not require you to litigate only in Curaçao.

Checkout on this website covers accommodation only. Anything else our concierge helps you arrange — a car, a transfer, an activity, tickets — is a separate request and a separate arrangement unless we expressly state otherwise in writing to you. Those extras are not sold here as a combined travel product, and nothing on this site should be read as offering one.
